General terms and conditions
of Kingugen Investments B.V. for BoothBahn · Last updated: 31 October 2026
1. Scope, provider
(1) These terms apply to all contracts for BoothBahn services between Kingugen Investments B.V., Am Kranzlberg 19, 82335 Berg, Germany ("we") and our customers ("you"). BoothBahn packages are sold exclusively in the BoothBahn app via Google Play; no contracts are concluded via the website boothbahn.com.
(2) Our offers are aimed at businesses and consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). A business is anyone acting in the exercise of their trade, business or profession when concluding the contract (Section 14 BGB). Provisions that apply only to consumers or only to businesses are marked as such.
(3) Deviating terms of businesses apply only if we expressly agree to them in text form.
2. Services
(1) A BoothBahn is a digital trade show walking plan created individually for you for a trade show you name. It consists of a researched selection of exhibitors matching your information, short or more detailed company profiles and a walking route over the floor plan with a schedule. It is delivered as an HTML file that you open in the BoothBahn app. Every BoothBahn carries a digital seal of authenticity (signature) with the order number, delivery date and the name of the person who ordered it.
(2) We offer two packages:
- Cruise: at most 40 of the best-matching exhibitors (top matches), each with a short description, plus walking route and day plan. If fewer exhibitors match your information, the BoothBahn contains fewer. A Cruise BoothBahn contains no stand timer. In the app you can view it, tick off stops, reorder them and add companies; notes are not included.
- Fast Lane: all matching exhibitors without limit, each with a more detailed profile, an assessment of why the exhibitor is relevant for you and an opening line, plus walking route and day plan. In the app it also includes notes (with email export) and the stand timer.
Scope, price and delivery time are shown in the app before you buy.
(3) We research publicly available sources (in particular the exhibitor list, floor plan and exhibitors' websites) using AI-assisted tools. We only state information from sources we have opened, mark uncertainties and do not guess. Exhibitor lists and floor plans may change before the show; we owe careful research at the time of creation, but not a complete exhibitor list or any particular business success (e.g. meetings, orders).
(4) A BoothBahn is a planning aid for a trade show visit that you decide on yourself. Whether, when and how you travel to a show is your decision, independent of the BoothBahn. Please take show dates, opening hours and the venue from the organiser's official information; the BoothBahn does not replace it.
(5) The BoothBahn app is free of charge. It is used to view and edit BoothBahn files; the example trade shows it contains are fictitious. Which app functions are available for a BoothBahn depends on the package bought (paragraph 2). The app only opens BoothBahns created by us and carrying our seal of authenticity. What you change in the app (order, ticks, notes, added companies, day plan) leaves the seal intact; shared or exported files can be imported again. The app does not open files that do not come from us or were changed outside the app.
3. Ordering and conclusion of contract
(1) The presentation of the packages on the website and in the app is not a binding offer.
(2) In the app you first enter your briefing (section 5) and choose a package. Before you buy, the app shows a summary with package, final price, delivery time and your information; until then you can correct input errors at any time. By completing the purchase in the Google Play purchase dialog you make a binding offer; the contract is concluded when Google Play confirms your purchase.
(3) Payment is processed through the Google Play billing system; the Google Play terms of service apply in addition. Refunds are also made via Google Play.
(4) After the purchase we send you a contract confirmation with all contract data, these terms and the withdrawal policy by email. The contract languages are German and English. We do not keep the contract text available for you separately.
4. Prices and payment
(1) The price shown in the app and in the Google Play purchase dialog applies. It is a final price including statutory VAT.
(2) The price is due when the contract is concluded. Payment methods are those offered by Google Play.
5. Your cooperation
(1) Every BoothBahn is based on your information (in particular the trade show, days, goal of the visit, companies you are and are not looking for, known customers, partners and competitors). You are responsible for its accuracy and completeness.
(2) You only give us data you are allowed to pass on. You only name personal data of third parties where it is needed for the BoothBahn.
6. Delivery
(1) We deliver the BoothBahn as a file by email to the address given in the briefing within the delivery time shown before the purchase. The period starts when the contract is concluded or, for consumers who have not agreed to an immediate start, when the withdrawal period ends. If information is missing, we ask; the period is then extended by the time until your answer.
(2) If we cannot deliver a BoothBahn in good time before the show, we will inform you without delay. If delivery is not possible by the start of the show, either party may withdraw from the contract; we will refund the price paid in full.
(3) If an unchanged BoothBahn delivered by us does not open in the app, write to us and we will deliver it again without delay.
7. Rights of use
You receive a simple, unlimited right to use the BoothBahn for your own purposes, edit it and pass it on within your company. Resale or making it publicly available is not permitted. You may not remove, change or circumvent the seal of authenticity.
8. Warranty
(1) The statutory warranty rights apply; for consumers in particular the provisions on digital products (Sections 327 et seq. BGB).
(2) For businesses, warranty claims become time-barred one year after delivery; this does not apply to claims under section 9(1).
(3) Please report errors (e.g. wrong booth numbers) as quickly as possible so that we can correct them before the show.
9. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given.
(2) For slightly negligent breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely (cardinal obligation), our liability is limited to the typical, foreseeable damage.
(3) The typical, foreseeable damage of a BoothBahn does not include the costs of your trade show visit, such as travel, hotel and subsistence costs, tickets, booth fees or working time, because these arise from your own decision to visit the show (section 2(4)).
(4) For businesses, liability under paragraph 2 is also limited in amount to the price paid for the BoothBahn concerned; liability for lost profit and indirect damage is excluded in the case of slight negligence.
(5) Otherwise, liability for slight negligence is excluded. These limitations also apply in favour of our employees and vicarious agents.
(6) Your statutory warranty rights (section 8), in particular to subsequent performance and a refund of the price for a defective BoothBahn, remain unaffected.
10. Right of withdrawal for consumers
Consumers have a right of withdrawal as set out in our withdrawal policy. Businesses have no right of withdrawal. You can also declare withdrawal via the "Withdraw from contract" function in the app or on our website (boothbahn.com/withdraw).
11. Data protection
How we process your data is described in our privacy policy.
12. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
13. Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which they have their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business in Berg (district of Starnberg), Germany.
(3) These terms are available in German and English. In case of discrepancies, the German version prevails.
(4) Should individual provisions be invalid, the rest of the contract remains valid; the statutory provisions replace the invalid provision.
